I'm stunned.

This is probably old news by now, but a NSync het writer auctioned a CD of their stories on E-Bay and the bid went to $265.

They auctioned fanfic on e-bay. I have no words. I don't agree with zines being sold on e-bay never mind a cd of fanfic from someone's site. Someone is setting herself up for a C&D order.

Then there's the whole thing about writing fanfic for profit, that's just insane.

I read that too and it's just staggering that somone would do that, but apparently she says she's safe from any legal things because the guys names are not copyrighted but I was always under the impression that they do get copyrighted along with the *Nsync name.

PS on another topic how did you do all the links on your LJ? I mean more than one link? Did that make any sense at all?

I've been following links this morning, and reading where she said she was okay because it's rps and has no copyright. But I think she's wrong, I'm no lawyer but images are copyright, and the name and probably loads of things that we fans don't know of. On the disk she had wallpapers of the guys, those had to be copyright. I thought I'd seen everything in fandom but this beats it all. I hate how it reflects badly on rpf too :(

This should not be construed as legal advice. . . . .
That writer is setting herself up for a world of hurt. It isn't just that 'NSync is trademarked, and the performers' images are the images of the trademark. The band has its own mechanisms for selling photos and would not look kindly at people siphoning off that stream. And people do have a proprietary interest in their own names.
She is also setting herself up for a huge lawsuit for defamation. She is writing about real people, attributing emotions and actions to them. I don't know how hard 'NSync's lawyers troll EBay for this stuff but if they find it, it could go very badly for her.
She's also calling attention to fanfic in the worst possible way. Face it, most fanfic exists because the orginal creators allow it to exist. If somebody starts making it worthwhile for the originals to go after it, a lot of nice stuff will disappear.

I was horrified when I saw that on E-Bay, I wasn't clear about the copyright thing but knew drawing attention to fanfic is a bad thing.

It just goes against everything I believe about fandom to make money from selling your own stories.

If you ever feel the need for a code for LJ just send me a comment. I've some spare.
